Drug Policy

It is the policy of MMI to maintain a working environment that is conducive to high work standards safe for our personnel and others having business with the Company. This policy restricts certain items and substances from being brought on or being present on Company / Contractor premises or on the job.

 

This policy also prohibits Company personnel / contractors and others working on Company premises or are on the job from reporting for work with detectable levels of certain drugs and other substances in their body and prohibits the unauthorized use of Company property or equipment by personnel or others.

 

The term "Company Premises" as used in this policy includes Company or its contractor's offices, vessels, barges, docks, yards, work locations, desks, lockers, recreational areas, parking lots, living areas, and any vehicle engaged in Company operation or parked on Company owned, leased, or rented property.

 

The term "On the Job" means anytime or anyplace an employee, whether regular, casual, contract, full-time, permanent, or temporary is engaged in Company work or business. This includes situations where an employee is traveling on Company business, at meetings, conferences, seminars, or training sessions whether by Company vehicle, personal vehicle, or common carriers. Also included are situations where an employee may be required to work off Company premises as with a client. Also included are all breaks or meal periods, since employees will be expected to return to work after such breaks and function safely and productively.

 

Exceptions may be made only with the express authorization of John Naylon for the use of alcohol, a legal intoxicant, for certain approved Company functions, such as annual parties, entertaining clients, etc. Even in such situations, employees will be expected to use moderation and good judgment. If authorized to drink alcohol, you will refrain from driving vehicles, operating or doing any work on vessels or operating machinery. Transportation will be provided for all company sponsored events where alcohol is served. Unless expressly authorized by John Naylon, employees will politely decline offers of alcohol from customers or visitors. All others are prohibited from possessing, using, or being under the influence of alcohol on the job.

 

The items and substances covered by this policy other than firearms, weapons and explosives, include illegal drugs or other mind altering substances, marijuana, alcoholic beverages, "look-alike" substances, inhalants, prescription drugs, or "over the counter" medications (except as noted below), and equipment, paraphernalia, or literature related to illegal drug or substance use.

 

Employees may maintain on Company premises prescription drugs and "over the counter" medications provided:

1. The drugs have been prescribed by a licensed doctor for the person in possession of the drugs;

 

2. The drugs are kept in their original container, bearing the name of the employee (patient), date, name of drugs, and directions for its use; and


3. The employee and his or her supervisor have signed a "Medical Permission" form covering the drugs in use.

The company would like every employee to voluntarily comply with this policy for his or her own safety, for the safety of other employees, guests, the general public, customers, and for the good of the Company. Because of the importance of this policy, the Company will from time to time take steps to ensure that this policy is being followed.

 

These steps may include the following:

1. Reasonable and random searches of Company premises and employees and others on the premises, including the personal effects and vehicles of such person;

 

2. Urine drug screen tests, breath tests, or other investigative examinations of such persons on the premises; and/or


3. Confiscation of prohibited items and substances, and where appropriate, delivery of such items to law enforcement authorities.

Personnel Found in Violation of the Policy:

Any employee / contractor found in possession of any of the items or substances prohibited by this policy shall be removed from the Company premises and shall be subject to disciplinary action, including discharge. Any personnel who, as a result of testing, is found to have identifiable traces of a prohibitive drug or substance in his or her system, regardless of when or where the drug or substance entered the employee's system, will be considered in violation of this policy, will be removed from Company premises, and will be subject to disciplinary action, including discharge.

 

Refusal to Comply with Search of Investigation:
Any contractor who refuses to comply with a search or investigation as described in this policy will be subject to removal from Company premises and to disciplinary action, including discharge.

 

Reporting to Work Under Influence of Prohibited Drug or Substance:
Any personnel who reports to work under the influence of or having traces of any prohibited drug or substance in his or her system will be subject to removal from Company premises and to disciplinary action, including discharge. Alcohol intoxication will be defined as Blood Alcohol Content (BAC) of .04%. DOT drivers are also prohibited from testing for alcohol at a level of .02% BAC, which will bar them from work as a driver under the DOT rules. Drivers who test at this level will also be subject to additional company discipline.

 

Contractor Employees and Third Parties:
Any contractor employees or other third parties on Company premises will be subject to this policy. Any such individual found in violation of this policy will be subject to removal from the premises and reported to the contractor, if employed as such.
